Lawyers representing Sam Bankman-Fried have expressed concerns about the impact of the prison environment on his productivity during the discovery process. A recent court filing has revealed that frequent interruptions have caused significant disruptions to Bankman-Fried's work. Reports suggest that Bankman-Fried is struggling to keep up with the increasing volume of evidence being presented against him. The defense team has raised objections to the last-minute disclosure of millions of pages of evidence, arguing that this could prejudice Bankman-Fried's chances of receiving a fair trial. No Internet And Frequent Disruptions

Sam Bankman-Fried is permitted to use an air-gapped laptop during specific hours on weekdays and weekends. However, the weekend hours are more limited. Despite the laptop being air-gapped, his legal team has reported disruptions caused by the prison staff during the allowed laptop access times. One of the main issues raised by Bankman-Fried and his lawyers is the interruptions experienced in the legal visiting room due to prison protocol, which has resulted in significant time loss. Specifically, over three days, the prison staff has requested that Bankman-Fried return to his cell for standard procedures such as a prisoner count, which has taken over 7.5 hours.

“The defendant was informed by MDC staff that he had to leave the legal visiting room at 2:30 p.m. and return to his unit for the prisoner count, which deprived him of approximately 4.5 hours of additional review time.”

Previous Complaints About Prison Conditions

Bankman-Fried, the founder of FTX, has previously expressed concerns about prison conditions. His legal team has requested temporary release on weekdays. On August 11th, his $250 million bond was revoked after private diary leaks and allegations of inappropriate liaisons with former FTX colleagues. The judge presiding over the case saw this as witness tampering and revoked the bond. Bankman-Fried has been held at the Brooklyn Metropolitan Detention Center, which has been reported to be one of the worst prisons in New York City. His legal team has requested his release on weekdays, stating that the prison environment is too restrictive and does not provide the necessary conditions for him to prepare for his upcoming trial. They have also argued that he would be unable to access and review new evidence for his pending trial.

“Just last week, the government produced three-quarters of a million pages of Slack communications, which were supposed to be produced months ago, that Mr Bankman-Fried will have no hope of reviewing under this schedule.”

Bankman-Fried has also complained about a lack of food and medication at the prison.


Temporary Release Not An Option

Bankman-Fried's legal team requested temporary release for him during weekdays, but Judge Kaplan did not agree with the proposal. Instead, the judge asked for alternative solutions. One suggestion was to provide hard drives with documents that could be delivered to the prison, but this idea was rejected. Another option was to transfer Bankman-Fried to a smaller prison with supervised internet access, but both the prosecution and prison officials opposed it. Therefore, Bankman-Fried will remain at the Brooklyn Metropolitan Detention Center until further review.
